O que é o MW FITNESS

Um app de treino criado por Matheus Lima Cypriano. Existe um único coach: eu. Eu monto o seu treino, acompanho o que você registra e ajusto — e todo treino que chega até você tem o meu nome nele.

O MW FITNESS não é serviço médico. Não faz diagnóstico, não trata e não substitui médico, fisioterapeuta ou nutricionista. Antes de começar — e principalmente se você tem alguma condição de saúde — fale com um profissional de saúde. Se doer, pare. Dor não é parte do treino.

Quem pode usar

É preciso ter 18 anos ou mais. O app não é feito para menores de 18, e eu não abro conta para quem não tem essa idade.

Você precisa dar informações verdadeiras sobre si — e isso vale principalmente pro que você me conta sobre a sua saúde, porque é com isso que eu decido o que te mandar fazer. Se alguma coisa mudar (uma lesão nova, uma cirurgia, uma gravidez, um remédio novo, uma dor que apareceu), me avise antes da próxima sessão.

O que é seu

A conta é sua e não se empresta. Você é responsável pelo que faz com ela e por manter a senha em segurança.

Contar as suas lesões e limites é parte do trato. A prescrição se adapta ao que você relata — o que o app não sabe, ele não protege.

O que é meu

Os treinos, os programas, os vídeos e os textos do app são meus. Use pra treinar; não republique nem revenda.

O que você registra — seu treino, seu peso, suas fotos — continua seu. Eu só uso pra te treinar.

Plano e pagamento

O plano é uma cobrança mensal só, paga pelo cartão dentro do app, e ela renova sozinha todo mês até você cancelar. O acompanhamento — seu treino montado e ajustado por mim — está sempre incluído; o que muda entre os planos é quantas sessões presenciais vêm junto por mês. Os valores de cada plano aparecem na Conta, antes de você escolher.

As sessões do seu plano caem no seu saldo todo mês e valem 3 meses a partir do mês em que entraram. Marcar uma sessão gasta uma do saldo.

Pausar: se você precisar parar por um tempo, a cobrança para e o prazo do seu saldo para junto — você não perde o que já pagou.

Também dá pra marcar uma sessão avulsa, sem plano, pagando na hora de marcar — o pagamento é o que confirma o horário. O preço aparece antes de você confirmar.

Marcar fecha 2 horas antes de a sessão começar, e ninguém marca nada com mais de 3 meses de antecedência.

Cancelar a sessão: com mais de 24 horas de antecedência, ela volta pro seu saldo como crédito (um crédito vale uma sessão, mesmo que o preço mude depois) — com a validade que tinha antes, não uma nova, e nunca com menos de 30 dias a partir do cancelamento, mesmo que o prazo original fosse acabar antes disso. Com menos de 24 horas, o valor não volta — a tela avisa isso antes de você confirmar.

Cancelar a assinatura: quando quiser, pela Conta. Ela continua valendo até o fim do mês que você já pagou e não renova de novo. Não há devolução proporcional, e fora o crédito da sessão acima não há reembolso.

Quem cobra é o Stripe. O app nunca vê o número do seu cartão: os campos de pagamento são do Stripe, mesmo quando aparecem dentro da tela do app. Se você apagar sua conta, a cobrança é cancelada junto.

Se eu não puder atender

Se eu cancelar, ou não puder comparecer a uma sessão marcada, ela volta pro seu saldo com prazo novo — 3 meses a partir dali — e, se você preferir, eu devolvo o valor dela. Quando for por minha causa, a janela das 24 horas não conta contra você.

Se eu ficar impedido por muito tempo — doença, acidente, alguma coisa fora do meu controle —, eu te aviso, paro a cobrança e a gente combina: esperar com o seu saldo congelado, ou eu devolver o que você pagou e não usou.

Desistir nos primeiros 14 dias

Como você assina pelo app, sem me encontrar pessoalmente, a lei britânica te dá 14 dias pra desistir, contados do dia em que você assina, e sem precisar dar motivo. É só me escrever: matheuscypriano@icloud.com.

Se nesses 14 dias você já tiver usado o serviço — eu montei a sua semana, respondi você, atendi uma sessão —, eu desconto a parte que já foi prestada e devolvo o resto em até 14 dias, no mesmo cartão. Se você não usou nada, devolvo tudo.

É por isso que a tela de pagamento te pede pra confirmar que você quer começar na hora: sem essa confirmação, eu teria que esperar os 14 dias antes de montar o seu primeiro treino. Marcando, você começa hoje — e continua podendo desistir, só que o que já foi feito é descontado.

Isso vale pra primeira assinatura e pra cada sessão avulsa que você comprar. Passados os 14 dias, valem as regras de cancelamento acima.

A sessão presencial

O local é combinado com você antes de marcar — vale guardar a confirmação. Chegue com o que você precisa pra treinar; se você chegar atrasado, a sessão termina no horário marcado, porque depois dela pode ter outra pessoa.

Faltar sem avisar gasta a sessão do mesmo jeito — é a mesma regra das 24 horas acima. Se você avisar, mesmo em cima da hora, eu prefiro sempre saber.

Sair e apagar

Dá pra sair quando quiser e apagar a conta pelo próprio app. Apagar é definitivo: o histórico não volta. Exporte antes se quiser guardar.

Apagar a conta apaga também o seu saldo de sessões, e ele não vira dinheiro de volta. Se você tem crédito e pretende usar, use antes de apagar.

Se eu precisar encerrar

Eu posso encerrar o nosso acordo, avisando você, se estes termos forem quebrados — emprestar a conta, revender o meu material, tratar mal a mim ou a alguém, ou ignorar uma orientação de segurança que eu dei. Também posso parar de te treinar se eu acreditar, de verdade, que treinar não está seguro pra você agora: isso é decisão profissional, não castigo.

Em qualquer um desses casos eu devolvo o que você pagou e não usou — os dias que sobram do mês e as sessões que ainda estiverem no seu saldo.

Até onde eu respondo

Faço o app funcionar bem, mas não prometo que ele nunca vai falhar ou ficar fora do ar. Treinar tem risco, e a decisão de executar cada exercício é sua — respeitando a orientação do seu médico.

E sendo claro sobre a parte que a lei não deixa ninguém assinar por baixo: nada nestes termos limita a minha responsabilidade por morte ou lesão pessoal causada por negligência minha, nem por fraude, e nada aqui tira os direitos que a lei te dá como consumidor. Se alguma linha daqui não valer, o resto continua de pé.

Se estes termos mudarem

Aviso no app antes de valer, e digo o que mudou.

O mesmo vale pro preço: se eu mudar quanto custa o seu plano, eu te aviso antes da próxima cobrança. Se você não concordar, dá pra cancelar antes de a mudança valer, sem custo nenhum — você nunca é cobrado num preço que não aceitou.

Lei e foro

Eu moro e trabalho em Londres, Reino Unido, e você também está no Reino Unido. Estes termos seguem a lei da Inglaterra e do País de Gales, nos tribunais de lá.

What MW FITNESS is

A training app built by Matheus Lima Cypriano. There is one coach: me. I build your training, follow what you log and adjust it — and every session that reaches you carries my name on it.

MW FITNESS is not a medical service. It does not diagnose, does not treat and does not replace a doctor, physiotherapist or dietitian. Before you start — and especially if you have any health condition — speak to a healthcare professional. If it hurts, stop. Pain is not part of training.

Who can use it

You must be 18 or over. The app is not made for under-18s, and I do not open accounts for anyone below that age.

You need to give truthful information about yourself — and that goes above all for what you tell me about your health, because that is what I build your training with. If anything changes (a new injury, surgery, pregnancy, a new medication, a pain that showed up), tell me before the next session.

What is yours

The account is yours and is not to be shared. You are responsible for what you do with it and for keeping your password safe.

Telling me about your injuries and limits is part of the deal. The training adapts to what you report — what the app does not know, it cannot protect.

What is mine

The training, the programmes, the videos and the texts in the app are mine. Use them to train; do not republish or resell them.

What you log — your training, your weight, your photos — stays yours. I only use it to coach you.

Plan and payment

The plan is a single monthly charge, paid by card inside the app, and it renews on its own every month until you cancel. Coaching — your training built and adjusted by me — is always included; what changes between plans is how many in-person sessions come with it each month. The price of each plan is shown in Account, before you choose.

Your plan's sessions land in your balance every month and are valid for 3 months from the month they arrived. Booking a session spends one from the balance.

Pausing: if you need to stop for a while, the charge stops and your balance's clock stops with it — you do not lose what you have already paid for.

You can also book a one-off session, without a plan, paying at the moment you book — the payment is what confirms the slot. The price is shown before you confirm.

Booking closes 2 hours before a session starts, and nobody books anything more than 3 months ahead.

Cancelling a session: with more than 24 hours notice, it returns to your balance as credit (one credit is worth one session, even if the price changes later) — with the expiry it already had, not a new one, and never with less than 30 days from the cancellation, even if the original expiry would have run out before that. With less than 24 hours, the value is not returned — the screen warns you about this before you confirm.

Cancelling the subscription: whenever you want, from Account. It stays valid until the end of the month you have already paid for and does not renew again. There is no pro-rata refund, and apart from the session credit above there is no refund.

Stripe is who charges you. The app never sees your card number: the payment fields belong to Stripe, even when they appear inside the app's screen. If you delete your account, the charge is cancelled with it.

If I cannot make it

If I cancel, or cannot make a booked session, it returns to your balance with a new expiry — 3 months from then — and, if you prefer, I refund it. When it is on me, the 24-hour window does not count against you.

If I am out for a long stretch — illness, an accident, something outside my control — I tell you, I stop the charge and we agree what to do: wait with your balance frozen, or I refund what you paid and have not used.

Withdrawing in the first 14 days

Because you subscribe through the app, without meeting me in person, UK law gives you 14 days to change your mind, counted from the day you subscribe, and with no reason needed. Just write to me: matheuscypriano@icloud.com.

If within those 14 days you have already used the service — I built your week, I answered you, I ran a session — I deduct the part already delivered and refund the rest within 14 days, to the same card. If you used nothing, I refund everything.

That is why the payment screen asks you to confirm that you want to start right away: without that confirmation I would have to wait the 14 days before building your first session. By ticking it you start today — and you can still withdraw, only what has already been done is deducted.

This applies to your first subscription and to each one-off session you buy. After those 14 days, the cancellation rules above apply.

The in-person session

The place is agreed with you before you book — worth keeping the confirmation. Come with what you need to train; if you arrive late, the session still ends at the scheduled time, because someone may be booked after you.

Not turning up without telling me spends the session all the same — it is the same 24-hour rule as above. If you do tell me, even at the last minute, I would always rather know.

Leaving and deleting

You can leave whenever you want and delete your account from the app itself. Deleting is final: the history does not come back. Export first if you want to keep it.

Deleting your account also deletes your session balance, and it does not turn back into money. If you have credit and mean to use it, use it before deleting.

If I need to end it

I can end our arrangement, giving you notice, if these terms are broken — sharing the account, reselling my material, treating me or anyone else badly, or ignoring a safety instruction I gave you. I can also stop training you if I genuinely believe training is not safe for you right now: that is a professional decision, not a punishment.

In any of those cases I refund what you paid and did not use — the remaining days of the month and any sessions still in your balance.

How far I answer

I keep the app working well, but I do not promise it will never fail or never be down. Training carries risk, and the decision to perform each exercise is yours — following your doctor's guidance.

And to be clear about the part the law lets nobody sign away: nothing in these terms limits my liability for death or personal injury caused by my negligence, nor for fraud, and nothing here removes the rights the law gives you as a consumer. If any line here turns out not to hold, the rest stands.

If these terms change

I tell you in the app before they apply, and I say what changed.

The same goes for the price: if I change what your plan costs, I tell you before the next charge. If you do not agree, you can cancel before the change applies, at no cost — you are never charged a new price you did not accept.

Law and jurisdiction

I live and work in London, United Kingdom, and you are in the United Kingdom too. These terms follow the law of England and Wales, in its courts.
